1. Introduction

This Privacy Policy describes how your personal and health information may be collected, used, and disclosed by Offline Telehealth LLC (“Offline Telehealth,” “we,” “us,” or “our”). It applies to our website and all related services. This policy also serves as our Notice of Privacy Practices under HIPAA.

Please read this policy carefully. If you disagree with its terms, please discontinue use of our site and services.

2. Who We Are

Offline Telehealth LLC owns and operates this platform. We connect patients with independent licensed healthcare providers for telehealth consultations and prescription services.

We work with the following partners to deliver care:

Telehealth Platform: Rimo.co

Compounding Pharmacy: EPIQ Scripts, Foothills Pharmacy, and Emerald Compounding Pharmacy.

These organizations are responsible for providing clinical services and prescription fulfillment. Where applicable, we maintain signed Business Associate Agreements (BAAs) with all partners who access protected health information.

3. HIPAA Compliance

We are committed to protecting your personal and health information in accordance with the Health Insurance Portability and Accountability Act of 1996 (HIPAA), the HITECH Act, and applicable state laws.

  • While Offline Telehealth is not itself a HIPAA-covered entity, our affiliated medical groups and providers are covered entities
  • We may serve as a business associate to those entities
  • We are required by law to maintain the privacy and security of your protected health information
  • We will notify you promptly if a breach occurs that may have compromised your information
  • We will not use or share your information other than as described here unless you give us written permission
  • We follow the duties and privacy practices described in this notice

4. FTC Health Breach Notification

As a consumer-facing digital health platform, we are also subject to the FTC Health Breach Notification Rule (16 C.F.R. Part 318), effective July 29, 2024. In the event of a breach of unsecured personally identifiable health information, we will notify affected individuals without unreasonable delay and no later than 60 calendar days following discovery of the breach. For breaches affecting 500 or more individuals, we will notify the FTC simultaneously. Notification will be provided via email or other electronic means and will identify any third parties that acquired unsecured health information as a result of the breach.

  • Health history and intake questionnaire responses

  • Identity verification information

  • Pages visited and time spent on site

6. How We Use Your Information

We use the information we collect to:

  • Facilitate your telehealth consultation with a licensed provider
  • Process payments and fulfill orders
  • Communicate with you about your consultation and treatment
  • Comply with legal and regulatory obligations
  • Improve our website and services
  • Send you updates and communications you have consented to receive

We use conversion tracking tools, including Google Ads, to measure the performance of our marketing. These tools receive only that a purchase occurred and its dollar value. They do not receive your name, health information, diagnosis, or the specific medication or treatment prescribed.

7. How We Share Your Information

We do not sell your personal information. We may share your information in the following circumstances:

  • Licensed Providers: Your health information is shared with the licensed healthcare provider reviewing your case
  • Pharmacy Partners: Prescription information is shared with the compounding pharmacy fulfilling your order
  • Service Providers: We work with third-party vendors who assist in operating our website and services, all bound by confidentiality agreements and BAAs where applicable
  • Legal Requirements: We may disclose information if required by law, court order, or governmental authority
  • Public Health: We may disclose information to public health authorities as required by law
  • Serious Threats: We may disclose information if necessary to prevent a serious and imminent threat to health or safety
  • Abuse or Neglect: We may disclose information to authorities authorized to receive reports of abuse, neglect, or domestic violence
  • Business Transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction

We will never disclose your health information for marketing purposes or sell your health information without your written authorization.

8. Substance Use Disorder Records

If your care involves substance use disorder (SUD) treatment records, those records are subject to heightened confidentiality protections under 42 CFR Part 2, in addition to HIPAA. Under Part 2, SUD records may not be used or disclosed in civil, criminal, administrative, or legislative proceedings against you without your written consent or a court order meeting specific legal standards. These protections are stricter than standard HIPAA rules and we comply with both.

9. Your Rights

Depending on your state of residence, you may have the right to:

  • Access the personal information we hold about you
  • Request correction of inaccurate information
  • Request deletion of your information, subject to legal limitations
  • Request restrictions on how your information is used or shared
  • Request confidential communications in a specific way or location
  • Receive an accounting of certain disclosures of your PHI
  • Receive notification if your protected health information is compromised in a breach
  • Obtain a paper copy of this Notice at any time
  • File a complaint without fear of retaliation

California residents (CCPA/CPRA): You have the right to know what personal data we collect, request deletion or correction, opt out of the sale of personal information, and not be discriminated against for exercising your rights.

Washington residents: Washington’s My Health MY Data Act imposes additional consent, notice, and security requirements for consumer health data. Contact us for more information.

11. Cookies and Tracking Technologies

We use cookies and similar technologies, including conversion tracking pixels such as Google Ads, to enhance your experience and measure marketing performance. These tools do not receive your health information or details about your specific treatment. You may opt out of non-essential cookies through your browser settings.

12. Children's Privacy

Our services are not directed to individuals under the age of 18. We do not knowingly collect personal information from minors.

13. Changes to This Policy

We may update this Privacy Policy at any time. The latest version will always be available on our website. You may also request a printed copy at any time.

14. Complaints

If you believe your privacy rights have been violated, you may file a complaint with us or with the U.S. Department of Health and Human Services Office for Civil Rights. You will not be penalized for filing a complaint.
